Cardno ChemRisk’s Jennifer Pierce will be speaking at the American Conference Institute's 14th National Advanced Forum on Asbestos Claims & Litigation, June 26-27, 2013 in Chicago, IL. A jury in Los Angeles returned a defense verdict in mid-December 2012 with a 9-3 ruling in a lawsuit filed by a flavorings factory worker who allegedly contracted the rare lung disease bronchiolitis obliterans, which he blamed on exposures to chemicals used to make butter flavorings.  Cardno ChemRisk scientists Brent Finley, David Galbraith, and John Henshaw were asked to provide expertise in the areas of toxicology, medicine, and industrial hygiene, respectively.  Legal representation for Advanced Biotech was provided by Mr. Peter Garchie and Mr. Ruben Tarango.

Asbestos litigation is still considered one of the most important types of mass torts in the United States. Each year numerous companies, many of which are  end-product manufacturers of asbestos-containing products, file for bankruptcy as a result of the burden of asbestos litigation. On May 23, 2012 the Pennsylvania Supreme Court upheld a prior court’s ruling regarding the lack of scientific basis for the “every fiber counts” theory. It is commonly used by plaintiff’s experts in the courtroom to argue that inhalation of every asbestos fiber, regardless of mineral (fiber) type, is a contributing factor to the plaintiff’s disease.
